1. About this policy

This policy explains how Kass & Co Pty Limited trading as 4EVA Energy (ACN 106 309 344, ABN 77 106 309 344) (“4EVA Energy”, “we”, “us”) handles personal information. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

It applies to everyone we deal with, including website visitors, people who enquire about our programs (such as the Uniting Solar Opt-in Program), customers and residents whose homes or sites we assess or upgrade, installers and contractors who work with us, and suppliers.

You can deal with us anonymously or under a pseudonym for general questions. To assess your home, provide a quote, arrange an installation or create certificates under an energy scheme, we need to know who you are and where the work will be done.

2. What we collect

What we collect depends on how you deal with us.

If you make an enquiry

Your name, residential or site address, phone numbers, email address, preferred contact method and the details of your enquiry. For resident programs we also ask for the number of bedrooms and occupants in your home, so we can prepare for a conversation about a suitable system.

If we assess your home or site, or install equipment

  • Property details, such as roof type, access arrangements and existing electrical equipment.
  • Electricity account and usage information, such as your retailer, National Metering Identifier (NMI) and bills you choose to share.
  • Photos of your property and the installation, which may include location and time data recorded by the camera.
  • Records required by energy schemes, including nomination forms, signatures, compliance certificates and installation evidence.
  • Quote, deposit and payment records. We don't store full card or bank details on our website.

If you are an installer, contractor or supplier

Contact and business details (including ABN), licence and accreditation numbers, insurance details, training and induction records, and records of the work you perform on our behalf.

Sensitive information

We don't ask for sensitive information such as health information. If you tell us something sensitive to help us support you, for example an accessibility need for a home visit, we will only use it for that purpose, with your consent.

3. How we collect it

We mostly collect information directly from you: through forms on our website, by phone or email, and in person during a home or site visit. Sometimes it comes from others, including:

  • installers and contractors who work on our behalf and record evidence at your property;
  • the operator of your village or building, where you have been told they are referring residents to us or they need to arrange access;
  • energy scheme administrators and your electricity distributor, when checking or registering an installation; and
  • publicly available sources, such as licence and accreditation registers for installers.

If we receive information we didn't ask for and don't need, we will destroy or de-identify it where lawful to do so.

4. Why we use it

  • To respond to your enquiry and contact you using your preferred method.
  • To assess whether a solar, battery or energy-efficiency upgrade suits your home or site, and to prepare a quote.
  • To arrange and manage installations, including scheduling, access, quality checks and warranty support.
  • To create, register and sell certificates under government energy schemes, such as the NSW Energy Savings Scheme and Peak Demand Reduction Scheme, the Victorian Energy Upgrades program and the Small-scale Renewable Energy Scheme, and to apply for available rebates on your behalf.
  • To meet our legal, safety and scheme obligations, including audits by scheme administrators and regulators.
  • To manage our relationships with installers, contractors and suppliers.
  • To improve our services and, where you have agreed, to send you information about our programs.

We don't sell personal information.

We don't make decisions that significantly affect you using only automated processes.

5. Who we share it with

We share personal information only as needed for the purposes above, including with:

  • Installers and contractors who carry out assessments and installations for us.
  • Our service providers, including Themis Systems (our job and evidence management platform), HubSpot (our customer relationship management system), and our website, email and IT hosting providers.
  • Energy scheme administrators and regulators, such as IPART, the Essential Services Commission (Victoria), the Clean Energy Regulator and Building Commission NSW, as required to create certificates and demonstrate compliance.
  • Electricity distributors and AEMO, for grid connection approvals and registering systems on the Distributed Energy Resources Register.
  • Village or building operators, only with your consent or where needed to arrange access to your home or shared infrastructure.
  • Auditors, insurers and professional advisers, under confidentiality obligations.
  • Government agencies or others, where required or authorised by law.

Our service providers may only use your information to provide services to us.

6. Where it's stored and how we protect it

We store personal information in Australia. Our website, email, job and evidence management platform and customer relationship management system are all hosted in Australian data centres. Some of our providers' support staff may access information from outside Australia when providing technical support. Where that happens, we take reasonable steps to make sure it is handled consistently with the Australian Privacy Principles.

We protect information with access controls, staff training, secure systems and encrypted connections. No system is completely secure. If a data breach is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required by law.

7. How long we keep it

We keep personal information only as long as we need it for the purposes in this policy or as required by law. We keep installation and certificate records for at least 7 years after the work, as energy scheme rules require. Enquiries that don't go ahead are deleted or de-identified once they are no longer needed.

8. Marketing

We only send marketing if you have agreed to receive it. Submitting an enquiry form does not sign you up for marketing. You can opt out at any time using the unsubscribe link in our emails or by contacting us.

9. Our website and cookies

Our website uses only the cookies it needs to work. We don't currently use analytics or advertising cookies; if that changes, we will update this policy first. Information you submit through a form is sent over an encrypted connection to us or to HubSpot, depending on the form.

Links to other websites are not covered by this policy.

10. Accessing and correcting your information

You can ask for access to the personal information we hold about you, or ask us to correct it. Contact our Privacy Officer using the details below. We will respond within 30 days. There is no charge to make a request. If we refuse, we will tell you why and how to complain.

11. Complaints

If you have a concern about how we have handled your personal information, contact our Privacy Officer. We will acknowledge your complaint promptly and aim to resolve it within 30 days.

If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
